These Terms and Conditions (hereinafter referred to as “Agreement”) govern the use of services provided by Elite Notary Signings Agency (hereinafter referred to as “the Agency”) to clients (hereinafter referred to as “the Client” or “you”). By utilizing the services of the Agency, you agree to be bound by the terms and conditions outlined below:
Services:
a. The Agency provides professional notary signing services in the United States of America.
b. The Agency will make reasonable efforts to assign a qualified notary public to fulfill the requested signing services.
c. The signing services may include, but are not limited to, loan signings, legal document signings, and other notarization services as required by the Client.
Client Responsibilities:
a. The Client shall provide accurate and complete information regarding the signing requirements, including the date, time, location, and any specific instructions.
b. The Client is responsible for ensuring that all documents requiring notarization are properly prepared and executed prior to the scheduled signing appointment.
c. The Client shall provide valid identification and any other necessary documents as required by the notary public.
Fees and Payments:
a. The Client agrees to pay the Agency for the provided services based on the agreed-upon fee schedule or as otherwise agreed upon between the parties.
b. Fees may include travel expenses, waiting time charges, and any additional services requested by the Client.
c. Payments shall be made promptly upon receipt of an invoice from the Agency, unless otherwise specified in writing.
Cancellations and Rescheduling:
a. The Client must provide at least 24 hours’ notice for any cancellation or rescheduling of a signing appointment.
b. Failure to provide adequate notice may result in a cancellation fee being charged to the Client.
Confidentiality and Data Privacy:
a. The Agency understands the importance of maintaining the confidentiality of client information and will take reasonable measures to protect it.
b. The Client acknowledges and agrees that the Agency may collect, use, and store personal information and documents provided by the Client for the purpose of fulfilling the requested services.
Limitation of Liability:
a. The Agency and its notary publics shall not be held liable for any damages, losses, or claims arising from the signing services, except in cases of gross negligence or willful misconduct.
b. The Agency shall not be responsible for any errors or omissions in the documents provided by the Client.
Governing Law and Jurisdiction:
a. This Agreement shall be governed by and interpreted in accordance with the laws of the state of [State], United States.
b. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in [County], [State].
Amendments and Termination:
a. The Agency reserves the right to amend these Terms and Conditions at any time. The updated terms will be effective upon posting on the Agency’s website or providing notice to the Client.
b. Either party may terminate this Agreement by providing written notice to the other party. Termination shall not affect any accrued rights or liabilities prior to the termination date.
Entire Agreement:
This Agreement constitutes the entire understanding between the Agency and the Client and supersedes all prior agreements, oral or written, relating to the subject matter herein.
By utilizing the services of Elite Notary Signings Agency, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
